OCT 2 7 <br />1987 <br />RooK <br />69 rAGE831. <br />Planner Nearing commented <br />that there has been a <br />lot of Board <br />action on this property. It has been heard many times, approxi- <br />mately -twenty in all. He advised that staff still feels LD -2 is <br />appropriate for the area and emphasized that a Land Use designa- <br />tion is not necessary to control the density, which can be <br />controlled by other means. <br />Commissioner Wheeler asked if there are any residences there <br />now that don't conform to RS -3 usage, and Planner Nearing <br />believed there were none that would be non -conforming. <br />Director Keating believed there were several on the property <br />to the west of the, canal, but the subject property is made up <br />primarily of the holdings of one large land owner. <br />Commissioner Wheeler wished to know if there is any date set <br />for servicing this area with utilities, and Planner Nearing <br />advised that this is an urban service area listed in the <br />Comprehensive Plan for service between 1990-2000. With the <br />utilities now being developed, this probably could be moved <br />forward, but unfortunately, with lower density, it is far more <br />costly to install the urban services. <br />Commissioner Eggert pointed out that the density is already <br />there, and Planner Nearing noted that under the Comprehensive <br />Plan, the permissable density is 6 upa; however, currently with <br />RS -3 zoning, it could not develop at that. <br />Commissioner Eggert commented that the P&Z Minutes talked <br />about this being a "taking," and she did not see why. <br />Attorney Vitunac stated that as long as the owner has a <br />beneficial use remaining on his property, there is no "taking." <br />The Chairman asked if anyone present wished to be heard. <br />Ennis Proctor, owner of 17 acres on 69th St. (North Winter <br />Beach Road), advised that he has listened to the Commission go <br />along with the Planning & Zoning Commission on every recommenda- <br />tion they have made today, and apparently this matter has gone <br />through about 20 hearings, but he was informed there is a lot of <br />politics involved here and was told by a neighbor not to bother <br />58 <br />
