BOOK 70,A <br />,A89 <br />exercise promptly any rights given hereunder shall not operate to <br />forfeit any of said rights. <br />THIRTEENTH: It is further understood and agreed <br />between the parties hereto that any charges against the lessee by <br />the lessor for services or for work done on the premises by order <br />of the lessee or otherwise accruing under this contract shall be <br />due and unpaid. <br />FOURTEENTH: Lessee will provide personal property and <br />fire and casualty insurance on the building on the premises in <br />their full insurable value. Lessor shall continue to hold its <br />existing Commercial Property Coverage and Commercial General <br />Liability Coverage Policy, Number 77 -PR -546-424-8000, with <br />Nationwide Insurance Company, Columbus, Ohio. Lessor shall pay <br />Five Hundred Dollars ($500.00) toward the purchase of this policy <br />and Lessee will pay any remaining balance. Lessor will designate <br />Lessee as a Named Insured on the Nationwide policy. Lessor shall <br />Provide Lessee with a Certificate of Insurance within 14 days of <br />the effective date of the policy and shall obtain in writing an <br />obligation from the insurer to notify Lessee in writing at least <br />20 days prior to cancellation or refusal to renew any such policy. <br />Lessee shall further procure and maintain during the term of the <br />lease public liability. insurance with. coverage of One Hundred <br />Thousand Dollars ($100,000.00) for each person injured and Two <br />Hundred Thousand Dollars ($200,000.00) for any one accident, such <br />limits to be adjusted from time to time to match the waiver of <br />Sovereign Immunity limits in Section 768.28 Florida Statutes. <br />Lessor shall be named as an additional insured on all such policies <br />and lessee agrees to obtain in writing an obligation from the <br />insurers to notify lessor in writing at least twenty (20) days <br />prior to cancellation or refusal to renew any such policy. To the <br />extent permitted by law, lessee will be responsible for all claims, <br />demands, suits, liabilities, damages and losses arising out of or <br />resulting from the negligent acts of its employees, agents, or <br />representatives and hold the landlord harmless and indemnify the <br />landlord therefor. The lessee shall not use the premises in any <br />manner that will increase risk covered by insurance on the building <br />where the premises are located in such a manner as to increase the <br />rate -of insurance premium covering the building. Lessor shall pay <br />the first Five Hundred Dollars ($500.00) of each annual premium due <br />for the insurance described herein and lessee shall pay the balance <br />of the premium over and above Five Hundred Dollars ($500.00) each <br />year. <br />FIFTEENTH: Lessee expressly agrees that the lessor will not <br />be responsible for any -repairs or maintenance to the building or <br />— g-r-a;a-e4s or any part of the leased premises. Lessee agrees to <br />maintain the leased premises in clean, sanitary and safe conditions <br />at all times and all grounds and building maintenance necessary, <br />provided that Lessee should not be required by this paragraph to <br />perform any structural repairs to the building costing more than <br />Five Hundred Dollars ($500.00). Lessor shall provide all necessary <br />janitorial services for the building and grounds maintenance. �/� <br />SIXTEENTH: Lessee shall not make any improvemenTs or <br />alterations to the leased premises without the prior consent of <br />lessor which shall not be unreasonably withheld. Lessee shall <br />submit any plans and designs for such improvements to the lessor <br />for approval and any improvements or alterations erected on the <br />leased premises shall upon expiration or termination of the lease <br />belong to the lessor without compensation to the lessee. <br />SEVENTEENTH: The lessee shall pay for all utilities <br />furnished to the premises for the term of this lease including <br />electricity, gas, telephone service, and water consumption but not <br />costs of installation of public water or sewer service or impact <br />fees or assessments therefor. <br />EIGHTEENTH: Either party may terminate this lease for good <br />cause shown by providing sixty (60) days notice to the other party. <br />52 <br />M M M <br />
