Pr" <br />JAN 2 6 1988 <br />LUOK 70 PAGE 7 <br />Attorney Vitunac reported that as of yesterday Mrs. Moon has <br />changed her offer from $375,000 to $325,000 with a quick closing <br />and it would be our problem to deal with the tenants. The <br />difference would give the County $50,000 to deal with the tenants <br />as we wish. <br />Attorney Sam Block, representing Mrs. Moon, explained that <br />all previous offers are rescinded. The original offer was <br />$375,000 with a donation of $50,000 towards the library project. <br />Further, the contract was in a different context in that it <br />expressed how and when the tenants would be dealt with and that <br />the County would not be free of the leases until 1991. After <br />talking with the County Attorney's office, they sent a contract <br />over yesterday for $325,000 with a 30 -day closing with the County <br />being responsible for taking care of the tenants. Mrs. Moon has <br />not signed the contract, however, as she is out of town. <br />Attorney Block felt that if Mrs. Moon were here today, she would <br />say that she should have retained an attorney on the first offer. <br />Mrs. Moon thought she could negotiate the termination of leases <br />with the tenants or go to eminent domain if it came to that. <br />Now she feels it is far out of her reach. The appraised price <br />was $375,000, and she is willing to sell it for $325,000 with the <br />County being responsible for the tenants. Attorney Block pointed <br />out that the County has the capability and staff, to deal with the <br />tenants, and if the tenants are not willing to negotiate, then to <br />proceed with eminent domain. He noted that there is one wooden <br />building on the property, the Allison residence, which the <br />Historical Society would be interested in moving. The <br />supermarket's lease expires in November, 1991, and there are no <br />options to renew. <br />Chairman Scurlock pointed out that originally we were told <br />that there were 2 years left on the supermarket lease, and now we <br />are told that there are 4 years. He understood that the <br />Laundromat has a 5 -year lease, which was signed in February, <br />1987, with a 5 -year option to renew. <br />64 <br />
