Keae ng CP <br />CommunityDeve o me Director <br />P <br />DATE: February 19, 1988 FRE: <br />SUBJECT: WOODLANDS SUBDIVISION <br />MAINTENANCE AGREEMENT <br />SECURITY AND CONTRACT <br />FOR CONSTRUCTION <br />THROUGH: Stan Boling <br />413. <br />Chief, Current Development <br />tA) <br />FROM: Robert E. wiegers / REFERENCES: <br />Staff Planner <br />woodlands <br />BWIEG <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at its regular <br />meeting of March 1, 1988. <br />DESCRIPTION & CONDITIONS: <br />On November 3, 1987, the Board granted final plat approval to the <br />Woodlands subdivision, -a 55 lot subdivision located on the north <br />side of 1st. Street S.W., to the east of The Meadows subdivision. <br />At that time, the owner/applicant, Norman Hensick, contracted with <br />the County to finish construction of some remaining subdivision <br />improvements. An irrevocable letter of credit in the amount of <br />$100,000.00 was posted to secure the construction contract. The <br />applicant is now requesting that the Board release the $100,000.00 <br />letter of credit, allow the developer to contract -out for the <br />future construction of sidewalks by posting the necessary surety, <br />and accept the warranty maintenance agreement with the necessary <br />maintenance bond. <br />ANALYSIS: <br />The Public Works department has inspected the subdivision and has <br />verified that all required improvements have been constructed and <br />are acceptable. Public Works has indicated that the original <br />construction contract and letter of credit may now be released. <br />The project engineer has certified that 115% of the actual cost <br />for future construction of sidewalks is $33,203.00, and has also <br />certified that 25% of the actual cost of the total required <br />subdivision improvements is $41,522.13. <br />Section 10(e)3 of the County Subdivision ordinance gives the Board <br />of County Commissioners "the discretion to grant the applicant a <br />two-year period, after final inspection of subdivision improve- <br />ments, to construct sidewalks if the applicant posts construction <br />security in the amount of one hundred and fifteen (115%) percent <br />of the construction costs". <br />The applicant has now submitted a contract for construction of <br />required improvements for the future sidewalks within the sub- <br />division with a new letter of credit, and a warranty maintenance <br />agreement with a maintenance bond. The Board may now acceptthe <br />warranty maintenance agreement with the appropriate security and <br />accept the new construction contract guaranteeing the construction <br />of sidewalks in the future. The applicant's submittals have been <br />approved by the County Attorney's office, and satisfy all appli- <br />cable County requirements. <br />RECOMMENDATION: <br />Staff recommends that the Board of County Commissionersrelease <br />the original $100,000.00 letter of credit, accept the amended <br />letter of credit allowing the developer to contract -out for the <br />future construction of sidewalks, and accept the submitted <br />warranty maintenance agreement and bond. <br />[MR 1 1988 <br />22 <br />ricif 71 FAcE120 <br />
