As to the quality of support they are <br />receiving, they have letters from Dr. Massey of Indian River <br />Community College, from Harbor Branch Foundation, from a local <br />lawyer who is active in the Nature Conservancy, etc. Mr. Putnam <br />then quoted sentences from recent cases mentioned in the Florida <br />Bar publication called "Florida Zoning and Land Use Planning" • <br />stating that an existing ordinance can be amended when so <br />required by the public interest of the governmental unit, and <br />that if it can' be shown to be in•the current public need, it will <br />be upheld. He, therefore, urged the Board not to be afraid of <br />lawsuits as he believed they would be making an effort to <br />preserve the public health and safety. <br />Mr. Putnam then went on to address the question of the value <br />of this land, noting that he has many years experience with <br />acquisition of land and his state had a policy of paying fair <br />market value. He believed we could do that here, and felt that <br />the fair market value as of June, 1983, before it was rezoned to <br />commercial is the fair market value that should be paid now. <br />Chairman Scurlock wished to make it very clear that issue is <br />not what is under discussion today and we cannot consider that in <br />our deliberations. <br />Mr. Putnam urged the Commission not do anything today that <br />will artificially inflate the price of the land but rather give <br />their Society at least six months to get their funds and effort <br />together.
