Vista Properties came before this Commission with Gordon Johnston <br />representing 'them, they were asking for a 10 acre piece on the <br />front of McKee Jungle Gardens to be commercial. What they <br />wanted to do in 1983 was build Village Shops on the 10 acres in <br />the front and build condos in the back, and he has the court <br />reporter's transcript of that meeting. They came in to the <br />Commission that day and were told the small area of commercial <br />would constitute strip zoning, and that Commission proceeded to <br />pass a Motion to change the Comprehensive Plan to have all 20 <br />acres commercial. Mr. Ewing stressed that they never wanted 20 <br />acres commercial; they had something entirely different in mind, <br />and now it is turned around completely and said that they misled <br />everybody by saying they were going to build Village Shops on the <br />20 acres, which was not the intent. <br />Mr. Ewing continued that he is a condo developer, not a <br />commercial developer; so, when they got the 20 acres commercial, <br />he had to go out and hunt for a commercial developer over the <br />next four years. He finally found a group he thought was a good <br />developer, Leonard Farber, and entered into a contract to sell <br />him 20 acres of ground and he was to build a shopping center. He <br />then designed a site plan and spent a lot of money, but now they <br />don't have site plan approval. At this point he is back where he <br />was in 1983, and the Board now is telling him you can do what you <br />wanted to in 1983. In the meantime, however, he has been paying <br />taxes for five years on commercially zoned property. Mr. Ewing <br />emphasized that he abides by the county rules; they gave him 20 <br />acres commercial; he moved ahead and proceeded to comply with all <br />the county ordinance as he always has; and now they won't approve <br />that. So what do they want him to do? <br />James Haeger, 1906 33rd Ave., spoke in regard to the effort <br />to save the Jungle Gardens, and advised that he has been shown <br />brochures that were sent all over the United States trying to get <br />people to buy in the Gardens and saying that area will remain <br />gardens from now to perpetuity. <br />APP 26 1988 <br />55 <br />Roar 72 p!�E214 <br />
