5. <br />-- Bathroom Facilities. A full bathroom with toilet, <br />sink and tub or shower shall be provided for each <br />five (5) residents. An additional toilet and sink <br />shall be provided for each additional group or four <br />(4) persons or less. <br />To avoid an undue concentration of group care facilities <br />.in one area, all such facilities shall be located at <br />least 1,200 feet apart, measured from property line to <br />property line_. <br />6. If located in a single family area, the home shall have <br />the appearance of a single family home. Structural <br />alterations shall be of such a nature as to preserve the <br />residential character of the building. <br />7. The facility shall satisfy all applicable off-street <br />parking requirements of Section 24. The facility shall <br />meet or exceed all open space requirements for the <br />respective zoning district. <br />8. The maximum capacity of such facilities shall not exceed <br />the applicable number' permitted by the Department of <br />Health and Rehabilitative Services. <br />9. Any group home permit is nontransferable. If the type <br />of resident changes or the resident capacity increases <br />to such an extent that it would raise the facility to a <br />higher level group home as distinguished by the defini- <br />tion, the facility must be re-evaluated for an adminis- <br />trative permit or special exception approval. <br />10. Any group home application is subject to the publication <br />and notification processes as defined in section 27, <br />entitled "Administrative Procedures" in Appendix A of <br />the Code of Laws and Ordinances, known as the zoning <br />code, prior to the Planning and Zoning Commission's <br />public hearing. <br />Staff feels the Board of County Commissioners should consider the <br />following additional conditions to make this project more compati- <br />ble with uses in the area: <br />a. The residential center use should be approved speci- <br />fically for housing for the elderly and physically <br />handicapped and that any change in the clientele would <br />necessitate approval by the Board of County Commis- <br />sioners. <br />b. A buffer and 50' setback shall be established on the <br />north and east sides bordering the existing single- <br />family areas. <br />In staff's opinion, with the above conditions, the proposed -.use <br />satisfies the applicable residential center criteria in regards to <br />County policy. <br />RECOMMENDATION: <br />Based on the above analysis, staff recommends that the Board of <br />County CoMmissioners grant special exception approval for the <br />project, subject to the following conditions: <br />1. prior to site plan release, 25' of. property shall be dedi- <br />cated for the 30th Street right -of -'way; <br />JUL 5 1988 25 BOOK 73 FACT 165 <br />
