ALTERaTIM AND ANALYSIS: <br />Discussions have been held with Assistant County Attorney, <br />Sharon Brennan, to determine Proper procedure. <br />(Meinattached) <br />_ <br />tinder procedure 1V In Ms Brennan's letter, the Board of <br />Y� <br />coup 'do miissioners can sell property directly to adjacent <br />property owners if it is in the County's best interest to do so. <br />4Nv! <br />An offer to purchase Lot 7, Block 95, in the town of <br />Fellsmere, has been made by Ohmm E. Foster. an adjacent <br />PrnP Y owner, for $400.00. The property aPPraiser's <br />office has appraised this property at $1250,00. however, <br />the size of this lot makes it of little value to anyone <br />other than the adjacent property owner.• Staff has negotiated <br />with Mr. Foster to increase his offer but has not been <br />_ <br />successful. Mr. Foster, according to his letter proposes to <br />r <br />maw and maintain this property and return it to the tax rolls. <br />Staff has notified all adjacent property owners of our intent <br />to sell this property in accordance with section 5 of Ms <br />Brennan Is letter. <br />3. gE0L1NVDATION AMID FiaVDING: <br />�3 Staff rec=w!nds that we accept the proposed price of <br />$400.00 from 14r. Foster and -sell the property to him with a ._ <br />,•_ Deed <br />Wit Claim <br />Adminis-trator Balczun--noted that he originally felt this was <br />an unreasonable offer, but after driving up there and checking it <br />out, he changed his opinion. He now feels that the only solution <br />would be to sell the 25 -ft. wide lot to the adjacent property <br />owner. <br />Commissioner Wheeler felt the offer should be a little <br />closer to the appraised value of $1250, and Administrator Balczun <br />advised that we could always put them up for public sale, but <br />there is a question of who would want them other than the <br />adjacent property owners. <br />Attorney Vitunac pointed out that the lots also pose <br />liability and maintenance problems for the County. <br />ON MOTION by Commissioner Wheeler, SECONDED by , <br />Commissioner Eggert, the Board unanimously <br />(4-0) approved the sale of the subject property to <br />Ohmera E.
