Implementation of the wage increases for members of the employees within the <br />CWA Bargaining Unit must be delayed because the Union filed a challenge to <br />the election results. As you recall the employees within the bargaining unit <br />voted to cease representation by the CWA. Until the Public Employees <br />Relation Commission determines whether there were any election irregularities, <br />any attempt by the County= -to implement wage increases apart from <br />negotiations with the CWA would be considered an unfair labor practice. <br />Therefore, until a resolution of this issue comes from PERC, employees within _: <br />the bargaining unit will have delays in any salary increases. <br />Administrator Collins advised that -no budget amendments are <br />required today, because money has been allocated, but if any of <br />these funds develop shortfalls, staff will come back to the Board <br />at that time. Road & Bridge is the one most likely to have a <br />problem. <br />Administrator Collins explained that implementing the salary <br />increases for members of the Communications Workers of America <br />(CWA) bargaining unit has to be delayed because the union filed a <br />challenge to the election results. He understood that it is <br />because of an allegation that supervisory personnel were <br />soliciting signatures or something to that effect. That <br />challenge was heard by the Public Employees Relations Commission <br />(PERC) before the election and was rejected; therefore, we <br />suspect that unless there is some new information, the appeal <br />probably will be rejected again. However, PERC has informed us <br />that any attempt to implement a wage increase outside of the <br />negotiations with the CWA bargaining unit could be construed as <br />an unfair labor practice. Until this appeal is decided, we have <br />to implement any wage changes through the union, and we are not <br />likely to see them at the bargaining table until this appeal is <br />determined. Unfortunately, the wage increases for the employees <br />within the union will be deferred until this is resolved. <br />Commissioner Wheeler asked if the salary increases would be <br />retroactive, and OMB Director Joe Baird advised that we cannot <br />even discuss the matter now, and Administrator Collins explained <br />that if we say that now, that could be construed as an unfair <br />labor practice. <br />37 <br />OCT 11 1988 <br />491 <br />
