Keat}ng a _ ALCP <br />Director, Community Development Department <br />DATE: November 28, 1988 <br />SUBJECT: Demolition of Unsafe Structure <br />FROM: Ester L. Rymer, Directo <br />Building Division <br />It is requested that the information herein presented be given formal <br />consideration by the Board of, County Commissioners at the next <br />regularly scheduled meeting. <br />DESCRIPTION & CONDITIONS: <br />The structure located at 4735 34th Avenue, Smith Plaza Subdivision <br />(Parcel # 22-32-39-00007-0070-00017.0) is considered unsafe as de- <br />fined in Indian River County Code of Laws and Ordinances, Chapter 4, <br />Article II, Section 4-16. <br />It is the opinion of the inspector and the Building Official that <br />said structure is beyond practical repair and is a public nuisance; <br />therefore the structure has been condemned. Appropriate condemnation <br />cards have been posted on said structure. <br />The owner was initially notified on May 10, 1988, that repairs were <br />required on the structure, and was given thirty days to make neces- <br />sary repairs. The owner failed to make any repairs, and on October <br />11, 1988, he was given official notice to repair or demolish the <br />structure within thirty days. To date no work has been done. <br />ALTERNATIVES & ANALYSIS: <br />The Indian River County Code, Chapter 4, Article II, Section 4-21, <br />gives the Board of County Commissioners the authority to cause such a <br />building or structure or portion thereof to be demolished, secured or <br />required to remain vacant. Chapter 4, Article II, Section 4-22 gives <br />the Board of County Commissioners the authority to remove the struc- <br />ture as stated in 4-21, and cause a lien to be filed of record for <br />the costs of removal against the owner of the building. <br />CONCLUSION & RECOMMENDATION: <br />Staff recommends the Board of. County Commissioners declare said <br />structure a nuisance, and order the building to be demolished by the <br />County Road and Bridge Department. <br />After removal, in accordance with referenced Ordinances of Indian <br />River County, staff recommends a lien be filed of record for the <br />costs of removal against the owner or person in charge of said prop- <br />erty. <br />64 <br />
