Rymer, Director <br />Building Division <br />It is requested that the information herein presented be given formal <br />consideration by the Board of County Commissioners at the next <br />regularly scheduled meeting. <br />DESCRIPTION & CONDITIONS: <br />The structure located at 1041 10th Lane, Vero Beach, (Parcel # <br />12-33-39-00013-0120-00000.1) is considered unsafe as defined in In- <br />dian River County Code of Laws and Ordinances, Chapter 4, Article II, <br />Section 4-16. <br />It is the opinion of the inspector and the Building Official that <br />said structure is beyond practical repair and is a public nuisance, <br />therefore the structure has been condemned. Appropriate condemnation <br />cards have been posted on said structure. <br />The property is in the estate of Frances J. Radabaugh. The estate <br />was notified on two occasions that the property must be brought up to <br />code or demolished. Attached is a letter from the personal represen- <br />tative of the estate in which we were advised that the estate has no <br />funds to demolish the structure. <br />ALTERNATIVES & ANALYSIS: <br />The Indian River County Code, Chapter 4, Article II, Section 4-21, <br />gives the Board of County Commissioners the authority to cause such a <br />building or structure or portion thereof to be demolished, secured or <br />required to remain vacant. Chapter 4, Article II, Section 4-22 gives <br />the Board of County Commissioners the authority to remove the struc- <br />ture as stated in 4-21, and -cause a lien to be filed of record for <br />the costs of removal against the owner of the building. <br />CONCLUSION & RECOMMENDATION: <br />Staff recommends the Board of County Commissioners declare said <br />structure a nuisance, and order the building to be demolished by the <br />County Road and Bridge Department. <br />After removal, in accordance with referenced Ordinances of Indian <br />River County, staff recommends a lien be filed of record for the <br />costs of removal against the owner or person in charge of said prop- <br />erty. <br />DEC 1988 <br />67 <br />MY 75 PACE 317 <br />
