However, additional <br />work will run beyond the January 1, 1989 deadline. <br />ANALYSIS: <br />The remaining estuarine work largely consists of connecting the <br />system to the river, after verifying that DDT levels within the <br />system do not exceed background levels within the river. The <br />developer has stated that all the DDT test results and •connections <br />will not be completed until January, 1989. Therefore, both the <br />"construction" contract and the third letter of credit need to be <br />extended. <br />Staff has prepared an addendum (see attachment #2) to the existing <br />contra which extends the completion date to February 1, 1989 and <br />the ge period third letter of credit until April 1, 1989. <br />The County Attorney's office has reviewed the addendum and has <br />verified its legal form and sufficiency subject to execution by <br />the Board. The developer has signed the addendum. <br />To secure the extended contract, the developer has submitted an <br />extension of the third letter of credit. The letter of credit <br />extension has been reviewed by the County Attorney's office and <br />has been deemed legal and sufficient. <br />RECOMMENDATION: <br />Staff recommends that the Board approve the contract addendum, <br />accept the extended letter of credit, and authorize the Chairman <br />to execute the contract addendum. <br />ON MOTION by Commissioner Eggert, SECONDED by Com- <br />missioner Wheeler, the Board unanimously approved <br />Amendment extending Contract for Construction of <br />Required Improvements with Grand Harbor, Inc., <br />accepted the extended letter of credit and authorized <br />the Chairman's signature. <br />SAID CONTRACT W/EXTENDED LETTER OF CREDIT ON FILE IN THE OFFICE <br />OF CLERK TO THE BOARD. <br />C.
