Rymer, Direct <br />Building Division <br />SUBJECT: Building Permit #28308 <br />Odessa Clark <br />Please be advised that the information herein submitted is related to <br />the appeal requested by Odessa Clark which has been scheduled for the <br />meeting of January 10, 1989. <br />DESCRIPTION & CONDITIONS: <br />Indian River County has adopted the Southern Building Code Congress <br />International, Standard Building Code, as the applicable Building <br />Code for Indian River County. Section A, 103.6.1 (Copy attached) of <br />the Standard Building Code outlines the Building Official's responsi- <br />bility as it relates to permit intent and validity. <br />According to this code, a permit is invalid if the work authorized by <br />such permit is suspended or abandoned for a period of six months. <br />The Building Official has the authority to grant one or more exten- <br />sions for periods of ninety days. These extensions can be granted, <br />if necessary, when requested in writing prior to the expiration of a <br />permit. <br />ALTERNATIVES & ANALYSIS: <br />On March 3, 1977, a building permit was issued to Arkwell and Odessa <br />Clark, as owner -builders, for the construction of a residence to be <br />located at 4776 34th Avenue. To date, this permit has either been <br />extended or renewed five times. The last inspection made on work <br />completed was on November 26, 1986. The attached list identifies all <br />inspections made to date. <br />The most recent permit extension expired September 30, 1988. No in- <br />spections were requested during this extension period. The owner did <br />not request another extension until December, 1988, after the previ- <br />ous permit extension had already expired. The owner was given the <br />opportunity to present to the Building Official proof of active <br />construction, proof of materials purchased for construction, or proof <br />that sub -contractors were paid for construction relative to the per- <br />mit in question, but the owner was unable to provide adequate <br />documentation that work had progressed. As a result, the Building <br />Official has determined that this permit is invalid and a new permit <br />must be issued. <br />CONCLUSION & RECOMMENDATIONS: <br />It 'is the opinion of the Building Official that the owner has not <br />demonstrated a good faith effort to complete this project, nor has <br />she provided evidence of justifiable cause for an extension of this <br />permit. <br />The recommendation of the Building Official is that this permit be <br />declared invalid and that the owner be required to obtain a new <br />permit, paying any and all applicable fees. <br />17 <br />JAS 10X989 <br />X001( <br />/5 fl+GE 549 <br />
