doesn't start by December 31, 1993, the Board of County <br />Commissioners has a 9 -month period to reconsider the Comp Plan <br />amendment and the rezoning, and stipulates that no site plans can <br />be submitted for approval in the period. Basically, if the mall <br />doesn't go forward on this site, which has some 80 acres of <br />commercial zoning, the Commission may want to reconsider whether <br />or not they want to go into other types of commercial uses. <br />Commissioner Eggert noted that it states that the Board has <br />to reconsider the matter, and also that the D.O. would terminate <br />and they would have to go through the D.R.I. process if the mall <br />was to go forward. However, the land use and zoning would stay <br />in place unless the Board did something about it. <br />Mr. Boling advised that an addition was made to the first <br />sentence in Section 2.a on Page 3 of the D.O. After "pursuant to <br />Section 380.06, Florida Statutes," add "unless work has commenced <br />on the regional commercial facility (mall) as defined in 2.b. <br />(below) within 3 years from the effective date of the D.O." With <br />that addition, it means that within 3 years something has to <br />happen, either the mall has to start construction or the out <br />parcels. If the mall happens before the out parcels, fine. That <br />will satisfy that condition. <br />Chairman Wheeler was concerned that their plan would be kept <br />active if at any time during that 3 -year period they built some <br />kind of a commercial structure on one of the out parcels. He <br />emphasized that we are rezoning this with the primary thought of <br />it being a regional mall. <br />Mr. Boling pointed out that there are two thresholds. One <br />is a 3 -year threshold which would take place 3 years from now in <br />1991, and that is that something has to begin on the site, and it <br />doesn't have to be the mall.
