District approves it, they can dump it into the receiving body. <br />He wanted it to state somewhere in there that it is the intent of <br />Indian River County not to permit any discharge into the Indian <br />River via the Main Relief Canal. <br />Director Keating stated that they could put that in. <br />Under Fire Protection, Commissioner Eggert noted that <br />staff's memo states that the developer will be working with the <br />County to help secure a fire station site along Indian River <br />Boulevard north of 45th Street. She didn't know whether or not <br />Indian River Boulevard would be the right place for a station. <br />She hoped that sometime soon, with the North County Fire District <br />moving their stations around, we could get some kind of an <br />overall plan for fire stations in the county. <br />Commissioner Scurlock suggested that rather than getting <br />site specific, we indicate that there would be a contribution <br />towards fire protection, which would give the County the <br />flexibility of acquiring a piece of land somewhere else and <br />building a fire facility there. <br />Commissioner Bird agreed that we would want that flexibility <br />since the Winter Beach station is very close to this site. <br />Commissioner Scurlock asked if we could structure the <br />language such that they will work with us and will, in fact, make <br />a reasonable contribution for their share of fire protection if <br />it is demonstrated that there is a need, but Mr. Boling pointed <br />out that the existing language in 27.b leaves it rather open. <br />Assistant County Attorney Bill Collins felt that the County <br />is limited by the D.O.I. Statutes which say that effective July <br />1, 1986, a local government cannot include as a D.O. condition <br />for a D.R.I. any requirement that the developer contribute or pay <br />for land acquisition for construction of or expansion of public <br />facilities or portions thereof, unless the local government has <br />enacted a local ordinance which would require other developments <br />FEB 2 E i989 <br />29 BOOK 7b FACE 24 <br />
