have no paid fire response, their rating is significantly <br />different. <br />Attorney Collins emphasized that if the D.O. does not have a <br />provision for adequate facilities to provide the water flow for <br />fire protection, the D.O. cannot be approved under the Statutes. <br />However, this D.O. has the recommendation that the developer <br />participates in the Grand Harbor tank. <br />Mr. Boling explained that the way it is worded is that <br />capacity is available to the project. It doesn't have to be just <br />for that project, it can be a shared capacity situation, which is <br />what we anticipate happening. <br />With respect to the transportation conditions, Commissioner <br />Scurlock didn't understand why the intersection of U.S. #1 and <br />23rd Street was excluded from the analysis since it was so <br />important when we did the Grand Harbor DO1, as was the capacity <br />allocation of the two bridges and the one-way pair (Royal Palm <br />Boulevard and Royal Palm Way. <br />Mike Byrd from Kimley-Horn & Associates, traffic engineering <br />consultants for Harbor Town, explained that they looked at the <br />impact on roads or intersections where the project impact was <br />less than 5% of the level of service "D", peak hour, peak season <br />capacity. They looked at the intersection of U.S. #1 and 23rd <br />Street and determined that the project would not have a <br />significant impact. <br />Commissioner Scurlock was concerned that the accumulative <br />impact of the proposed mall and Grand Harbor would go over the 5% <br />impact. <br />Mr. Byrd pointed out that all new development in the county <br />is going to impact that intersection to some extent. <br />Public Works Director Jim Davis felt we were protected at <br />that intersection since both the Grand Harbor D.R.I. and this <br />D.O. provides for monitoring traffic on U.S. #1.
