APP _1199 <br />BOOK 78 `aH 537 <br />Commissioner Eggert recalled that when she served on the <br />Planning & Zoning Commission, this was one of the most difficult <br />areas to structure, and felt this area went to MXD because of the <br />presence of one house. She believed, however, that there was a <br />feeling that it would end up commercial. The intent was to put <br />in as much residential as we could along there, but this was one <br />of the biggest struggles they had. <br />Commissioner Bird pointed out that while the Board always <br />has felt strongly against strip commercial along U.S. #1, he <br />could not think of any new residential areas to the north or <br />south that have been created in this strip in spite of our <br />attempts to keep it residential. Since this property is only 400 <br />feet deep, he just was not sure that we could force residential <br />to exist there. <br />Commissioner Bowman suggested that it be zoned to something <br />in between residential and light commercial. She emphasized that <br />the Winter Beach Small Area Plan was to have solved all of these <br />problems, and this was designated as multi -family residential. <br />Commissioner Eggert pointed out that the Board asked staff <br />to revisit the Winter Beach Small Plan and that is being done in <br />conjunction with the new Comp Plan. <br />Chairman Wheeler opened the Public Hearing, and asked if <br />anyone wished to be heard in this matter. <br />Attorney Michael O'Haire, representing owner Theodore J. <br />Samuel, felt that Commissioner Bird has said it all, because you <br />have got to consider the physical characteristics of the <br />property. Henry Flagler built his railroad where it is; the <br />State came along and put Old Dixie Highway next to the railroad; <br />and U.S. #1 was built 300 feet away and running parallel to the <br />railroad and Old Dixie Highway. So, we have this strip of land <br />that is not now, and never will be, suitable for residential <br />development, and to force it into a residential category is to <br />invite the creation of slums.
