It <br />just cannot be forced into a residential use, and that is really <br />denying the property owner any realistic use of his property. <br />Attorney O'Haire recalled that the MXD was created for this area <br />just because nobody knew how to cope with the peculiar <br />geographical characteristics of this strip. The Winter Beach <br />Small Area Plan didn't deal at any length with the property Tying <br />east of the railroad and between U.S. #1 and Old Dixie Highway. <br />The concentration was west of the railroad. The property south <br />and north of this is commercially zoned, and will be used for <br />commercial. Attorney O'Haire emphasized that commercial is the <br />only reasonable use of the property, and urged the Board to <br />approve the rezoning as recommended by the Planning & Zoning <br />Commission. <br />Commissioner Bowman felt that Copeland's Landing and all <br />that nice residential area that will develop on the east side of <br />U.S. #1 deserves some protection, but Attorney O'Haire believed <br />that U.S. #1 is a considerable buffer between the two uses, since <br />it probably will go to more than 4 lanes in the future and have a <br />considerable median strip. <br />Jack Mitchell, 220 Sandpiper Point, pointed out that the <br />zoning notice they received states that CH (Heavy Commercial) <br />zoning was requested, and Director Keating explained that the <br />initial request for CH was reduced to CL (Limited Commercial) for <br />this meeting. <br />Mr. Mitchell objected to the applicant's request for <br />rezoning because he believed the applicant purchased the subject <br />property with the full knowledge of how it was zoned. He felt <br />that if this is permitted, it will result in spot zoning and have <br />an adverse impact on what U.S. #1 can be in the future as it <br />moves through Winter Beach.
