Commissioner Bird pointed out that there are special <br />exceptions in the various zoning categories, but Director Keating <br />advised that repair stores, variety stores, and furniture stores <br />are special exceptions, and gasoline sales at convenience store <br />locations are administrative permit uses. <br />Commissioner Bowman asked if CL would allow restaurants, and <br />Director Keating confirmed that it would. <br />Commissioner Bowman still maintained that the zoning should <br />be something between CL and residential. <br />Attorney O'Haire agreed with Commissioner Scurlock's concern <br />about convenience stores and gas stations, but felt it is the <br />use, not the location, that is the problem. He felt the way to <br />approach that is through the Zoning Code itself by adding more <br />restrictions regarding locations and requiring more buffering. <br />Chairman Wheeler felt this rezoning is a little premature <br />because of the ample supply of commercial/industrial zoning up <br />there, and because he was not so sure that it cannot be developed <br />at multi -family residential. He didn't believe we were <br />staggering any growth in that area either way, and Commissioner <br />Bowman agreed. <br />Commissioner Scurlock asked if we had the ability to choose <br />some other category today, and Attorney Vitunac advised that the <br />Board can consider any zoning in the same category that is Tess <br />intensive than what was advertised for the public hearing. <br />Director Keating advised that OCR (Office, Commercial <br />Residential District) is a lower zoning than CL and is limited <br />primarily to offices and some commercial accessory uses. It does <br />allow medical offices now. The PRO (Professional Office <br />District) is allowed in MXD and is more restrictive than OCR. <br />You cannot put a convenience store in PRO. <br />Commissioner Scurlock asked if the applicant would consider <br />anything lower such as the PRO, but Attorney O'Haire didn't feel <br />the property was suited for law offices or medical offices. <br />24 <br />� APR 111989 <br />ROOK Fi 6 mE 540 <br />
