Wie ersq, �li <br />g <br />Staff Planner, Current Development <br />DATE: June 22, 1989 <br />SUBJECT: PLAT VACATION REQUEST FOR A PORTION OF VILLAGE WALK <br />SUBDIVISION <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at its regular <br />meeting of July 11, 1989. <br />DESCRIPTION AND CONDITIONS: <br />Attorney Letitia E. - Wood, on behalf of Catalina Homes, Inc., is <br />requesting that the Board of County Commissioners vacate a portion <br />of the Village Walk subdivision as recorded in Plat Book 12, Page <br />87, Public Records of Indian River County, Florida. The portion <br />of the plat to be vacated (see attachment #3) includes lots 17-24, <br />25-30, and 31-42, all of which are owned by Catalina Homes, Inc. <br />The subject property is located within the Village Walk Subdivi- <br />sion, on the east side of 6th AVenue, immediately south of Waverly <br />Place (see attachment #2). <br />The portion of the plat to be vacated does not affect any public <br />or private facilities or access rights other than what relates to <br />the lots being vacated. The owner, Catalina Homes, Inc., was <br />recently granted final plat approval by the Board but has recently <br />decided to replat the vacated area in order to accommodate larger <br />lots. This plat vacation will be followed by a new final plat for <br />the affected area. <br />ANALYSIS: <br />According to Chapter 177.101 of the Florida Statutes, the Board of <br />County Commissioners has the authority to vacate plats in whole or <br />in part, returning all or portions of the property into acreage. <br />The vacation is accomplished by resolution of, the Board. Before <br />the resolution can be approved by the County Commission: <br />1. It must be shown that the persons making application for <br />the vacation own fee simple title to that part of the <br />tract covered by the plat sought to be vacated. <br />2. It must be shown that the vacation will not affect the <br />ownership or right of convenient access of persons <br />owning other parts of the subdivision. <br />3. Notice of the intention to apply to the County Commis- <br />sion for vacation of the plat must be published in a <br />newspaper of general circulation in the county in not <br />less than two weekly issues of the paper. <br />/' <br />RooK l <br />JUL 111989 <br />
