J U L 111989 Boor 7 7 P,1LsE <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Scurlock, the Board unanimously adopted <br />Ordinance 89-19, rezoning property generally located on <br />the east side of U.S. #1 between 53rd Street and the <br />North Relief Canal from CL, Limited Commercial <br />District, and RM -6, Multi -family Residential District <br />(up to 6 units/acre) to CG, General Commercial <br />District, <br />Commissioner Eggert asked the status of the right-of-way <br />acquisition on Phase III of Indian River Boulevard. <br />Public Works Director Jim Davis advised that the appraisals <br />are in the title policies have been written for the individual <br />parcels, and we are in the process of extending some offers to <br />the property owners at the appraised value. Basically, the <br />permitting is on hold until the County secures the right-of-way <br />in the mitigation areas. The agencies have indicated that they <br />are going to go ahead and take the review to completion, but they <br />will not issue the permit until we secure the land, which we hope <br />will be in 1-2 months. We have retained outside legal services <br />for the condemnation process if it goes that way, but we hope <br />they will accept our offer. Director Davis emphasized that the <br />timetable really depends on the right-of-way acquisition. <br />Commissioner Scurlock didn't want to see us get into endless <br />negotiations, but Director Davis advised that we plan to make one <br />offer at the appraised value, and if they don't respond within a <br />month, we will go ahead and file a quick -taking. He felt a <br />reasonable timeframe for people to drive to the hospital on Phase <br />III would be sometime during 1991. To be able to drive to 53rd <br />Street by the end of the next year, 1991, would depend on our <br />budget and how much the right-of-way acquisition is going to <br />cost. <br />21 <br />
