Chandler, County Administrator <br />FROM: James W. Davis, P.E., <br />Public Works Director <br />SUBJECT: Right -of -Way Acquisition - 74th Avenue South of <br />SR 60 - Philip and Deborah Delange - <br />Lot 17 - Westlake Estates <br />REFERENCE: Phil and Debbie Delange to Stan Boling <br />dated Oct. 9, 1989 <br />DATE: October 10, 1989 <br />DESCRIPTION AND CONDITIONS <br />While processing a building permit application to construct a <br />single family home on Lot 17, Westlakes Estates Subdivision, <br />staff determined that the subject lot, which has approximately <br />293' of frontage on 74th Avenue (Rangeline Road), was platted in <br />1978 with only 25' of right-of-way set aside for 74th Avenue <br />(secondary collector road with 80' wide designated right-of-way). <br />The County staff has requested that the owners set back their <br />proposed home an additional 55' from the existing west <br />right-of-way line of Rangeline Road. The following scenario <br />applies: <br />Total lot depth 156.04' <br />Less Collector Road right-of-way needed -55.0' <br />Less Deed RestrictionSetback (west -property line) -35.0' <br />Less Deed Restriction Setback (east aroperty_line) -35.0' <br />Depth remaining 31.04' <br />The road reservation area that the County is requesting is .37 <br />acre of the 1.05 acre lot. The Delange family cannot fit their <br />proposed house on the lot.. As a result, they request the County <br />purchase the entire lot for an amount equal to the average price <br />of lots recently\sold in the area, an 8% one year appreciation <br />amount, and expenses occurred in preparation for constructing the. <br />house. <br />ALTERNATIVES AND ANALYSIS <br />The paving and capacity expansion of 74th Avenue between SR60 and <br />16th Street is included in the County's 20 -Year Road Improvement <br />Program. The Thoroughfare Plan right-of-way for 74th Avenue <br />(80') in this area should be protected from encroachments. At <br />this time, Mr. & Mrs. Delange are offering to sell the entire lot <br />to the County since the right-of-way needs and deed restriction <br />setbacks are so substantial. Based on information available, <br />staff is of the opinion that a fair purchase price for the entire <br />lot would be as follows: <br />Purchase Price by Delange's 6/89 $24,500.00 <br />Cost of Lot Improvements plus expenses 1,616.25 <br />$26,116.25 <br />Alternative No. 1 <br />Offer to purchase the entire lot at $26,116.25. After the <br />80' right-of-way is secured, the County could resell the <br />36 <br />
