gentleman from the D.O.C. contacted him and told him that he knew <br />nothing about jails and that his comments were somewhat <br />incomplete. Commissioner Scurlock advised that he continued to <br />defend his position, and they pretty much backed away. As a part <br />of those discussions, however, he was told by that D.O.C. <br />representative - whose name he does not have right now, but he <br />can get it - that approximately 80% of all the rules and <br />regulations that relate to local prisoners were determined by the <br />Sheriffs' comments and their recommendations to the D.O.C. His <br />comments that were quoted in the paper, therefore, came from an <br />official of the D.O.C. Commissioner Scurlock did not know if <br />that statement is correct or incorrect, but that is what he was <br />told - that the local sheriffs make "80% of the rules." <br />Sheriff Dobeck advised that, speaking as president of the <br />Florida Sheriffs' Association, he could state that the sheriffs <br />had no input on those, and they have not in the 10 years he has <br />been Sheriff. Those rules (33-8) are put together by the D.O.C., <br />and the sheriffs are bound by them as the County Commission is <br />bound. <br />Commissioner Scurlock reiterated that this statement was <br />made to him by a D.O.C. official, and Sheriff Dobeck is now <br />refuting that. <br />Sheriff Dobeck stated that he would be glad to contact that <br />individual. He further noted that part of the intent of the <br />Sheriffs' suit is to eventually go after the 33-8 standards that <br />have put a stricter standard statewide on the local sheriffs and <br />county commissioners than the federal government puts on the <br />state. The sheriffs are trying to get more latitude as to what <br />we have to build and the various regulations we have to go by. <br />Commissioner Eggert agreed that some intense pressure must <br />be exerted to do something about this situation,especially if <br />the D.O.C. is indeed blaming the sheriffs, and Sheriff Dobeck <br />commented that it appears they are trying to "divide and <br />conquer." <br />DEC iJ 1989 <br />57 <br />Book. 78 F'",;x.698 <br />
