Mr. Flinn still maintained that the 80-20% division was not <br />equitable and that their assessment of $45,000 is too heavy a <br />burden. - <br />Director Pinto advised that the City doesn't have the <br />capacity and have gone on record that they are not going to <br />provide the capacity. Everything that we put through there now <br />is on loan, and we do have to build a south county wastewater <br />treatment plant. In fact, when we asked the City specifically if <br />they wanted us to increase the size of the line to take some of <br />their flow to the future plant, they said no. <br />Mr. Flinn pointed out that a potential sale of their <br />property went bad when the interested parties were told that they <br />had to pay all the impact fees up front for connecting to the 8th <br />Street sewer. <br />Director Pinto felt the worst thing that could happen to any <br />of that property along there is not to have wastewater service, <br />since it cannot be developed without sewers. <br />Mr. Flinn again pointed out that when they donated <br />right-of-way for the construction of Indian River Boulevard, they <br />were told that sewer lines were available at 8th Street, but now <br />they have to pay for those lines again. <br />Commissioner Scurlock wanted to see some documentation that <br />sewer capacity had been guaranteed at that time, but Mr. Flinn <br />stressed that you don't get any guarantees because those things <br />change every few weeks or so. <br />Director. Pinto wished to point out that they were never <br />assessed for lines on 8th Street. <br />Robert Flinn, 411 Live Oak Road, pointed out that if the <br />County had paid him and his brother for the 660 feet of frontage <br />on Indian River Boulevard, rather than their donating it, they <br />would have the money to pay this assessment. <br />Director Pinto wanted to make it clear that the deeding of <br />road right-of-way does not, and cannot, have any effect on <br />utility assessments. <br />23BOOK i F'•'Gr 7 <br />JAN 1990 <br />
