r <br />3. The Developer will be responsible for all impact fees <br />based upon the proposed project uses. <br />4. The Developer will be responsible for contracting with <br />a utility contractor to implement the construction of <br />the pumping station and force main system to the exist- <br />ing County pumping station.at Oslo Square Shopping <br />Center. The Developer will be reimbursed by Indian <br />River County for all construction costs for the pumping <br />station and force main system to County facilities <br />exceeding the sum of $135,000.00 plus Phase I impact <br />fees. The contract amount and the Utility Contractor <br />must be approved by the Director of the Department of <br />Utility Services. <br />5. The Developer will be responsible for all engineering <br />expenses related to the design of the pumping.station/ <br />force main system to County facilities; however, the <br />County will provide the Developer with: 1) the location <br />of the pumping station on-site; 2) the force main size; <br />3) selection of pumps and 4) the conceptual routing of <br />the project from the shopping center site to the County's <br />existing pumping station. <br />IN WITNESS WHEREOF, the County and the Developer have caused <br />these presents to be executed in their name the day and year first <br />above written. <br />Approved as to form <br />and legal sufficiency: <br />Charles P.
