JUN 5.199® <br />BOOK 80 MU219 <br />ANALYSIS: <br />The required improvements have not yet been constructed by the <br />developers. The developers have submitted a Contract for <br />Construction of Required Improvements and posted sufficient <br />security to guarantee construction of those required improvements <br />to be dedicated to the County. <br />Provision of a left turn lane for 37th Street and additional <br />traffic analysis (acceptable to the Public Works Director) for the <br />proposed subdivision are conditions of preliminary plat approval. <br />These conditions have been addressed, to the satisfaction of the <br />Public Works Director and the County Attorney's Office, in a <br />Developer's Agreement. The Developer's Agreement will be tied to <br />issuance of building permits on the subdivision lots and requires <br />the developers to provide adequate security for the off-site <br />requirements to be' determined-. All applicable requirements <br />regarding final plat approval have been satisfied. <br />RECOMMENDATION: <br />Staff recommends that the Board of County Commissioners grant final <br />plat approval for the CGN Subdivision, authorize the chairman to <br />execute the submitted Contract for Construction and the Developer's <br />Agreement, and accept the posted security. <br />ON MOTION by Commissioner Wheeler, SECONDED by <br />Commissioner Scurlock, the Board unanimously granted <br />final plat approval for the CGN Subdivision; authorized <br />the Chairman to execute the submitted Contract for <br />Construction and the Developer's Agreement; and <br />accepted the posted security. <br />CONTRACT AND COPY OF AGREEMENT ARE ON FILE IN THE OFFICE OF THE <br />CLERK TO THE BOARD <br />L.
