M <br />The lots listed opposite number 1, 4, and 5 above are <br />currently being used by the adjacent owner for Ingress and <br />egress to the owner's lot. These houses are built facing <br />the unopened roads.' 813 Cypress has a 15' set back from <br />Eagle. 806 Banyan has a 10' set back from Eagle. 606 <br />Dahlia has a 10' set back from Eagle. These houses all have <br />a garage at the front of the house side -loaded facing the <br />unopened street. It would not be possible to access the <br />garages by automobile without encroaching on a portion of <br />the County lots. There appears to me to be at least two <br />solutions, as follows: <br />1. The houses could be altered to front load on the opened <br />street. This could be expensive and would raise a - <br />question as to who should pay for the alterations. <br />2. The County could provide an easement on the lots for a <br />driveway. It would probably require a 5' to 10' <br />easement from the opened street to the garage. The <br />County Engineer could determine the minimum easement <br />necessary to access the garages. <br />In review of the foregoing, I recommend that the County <br />Commissioners take the following action, as follows: <br />1. The unencumbered lots 2 and 3 above be noticed for sale <br />by sealed bids. To this end, I have drafted a public <br />notice for your consideration. Sec. 125.35, Florida <br />Statutes requires publication once a week for at least <br />two weeks, and <br />2. The County Engineer prepare the minimum easements <br />necessary for automobile access to the garages adjacent <br />to lots 1, 4, and 5. These easements should be deeded, <br />at no costs, to the present owners of the houses <br />adjacent to lots 1, 4', and 5. When this is <br />accomplished these lots should also be offered for <br />sale subject to these easement. <br />COUNTY PROPERTY FOR SALE <br />TWO RESIDENTIAL UNIMPROVED LOTS <br />1.
