_I <br />JUN 131990 <br />BOOK �� fAGE •�� d' <br />must operate in a legal fashion, and as he understands it, we <br />must go through a competitive negotiation process. <br />Mr. Flick believed that what he needs is an RFP requesting a <br />private enterprise to respond to the needs of Indian River County <br />in the 9 block study area. He emphasized that he is offering <br />this on a cost efficient basis, and final negotiations would <br />include a maximum guaranteed price backed by a performance bond. <br />Mr. Flick informed the Board that he owns 80% of the property we <br />are looking at. If this is the final site selection and final <br />conclusion, there are other properties he has to deal with <br />amounting to about 50 of the total necessary real estate, but he <br />doe not perceive any difficulty with that. He stressed the <br />flexibility of his plan, emphasizing that it would be possible to <br />move the building. <br />Commissioner Scurlock asked if the Administrator felt he <br />could draw up an RFP that would allow for this type project, and <br />Administrator Chandler explained that this is not your normal <br />RFP. Under the Contractors Competitive Negotiation Act there are <br />certain criteria that have to be met. You have to be quite <br />specific; the RFP must be prepared and sealed by an architect or <br />engineer; and we do not have on staff anyone with the capability <br />or time to do that. We, therefore, first would have to go out <br />with an RFP to get on board an architect or engineer to design <br />that package. The time period for a normal RFP, including <br />interview, selection and negotiation, would be between 45 and 60 <br />days, after which the consultant would come on board to design <br />this specific package. The Administrator pointed out that, on <br />top of that, the Commission must adopt an ordinance regarding <br />"Design Build" projects. <br />Commissioner Scurlock asked about the "Lease Purchase" <br />process, and Administrator Chandler advised that when we were <br />looking at a North County Annex, he had an opinion from the <br />County Attorney that we could not go out and tell somebody to <br />design it, build it, and we will lease it from you. <br />18 <br />
