AUS 141990 <br />Commissioner Scurlock then brought <br />up the question <br />of <br />whether they have reserved utility capacity, and Director Keating <br />answered that the concurrency study indicates utilities are <br />available but he did not know if the capacity is actually <br />reserved. <br />Commissioner Scurlock agreed there is water capacity, but he <br />did not believe there is any sewer capacity actually available in <br />that entire corridor, and he did not believe you can pull a <br />building permit without sewer capacity. <br />Director Keating agreed that if you are saying the <br />facilities are not adequate, state law says you can't approve a <br />Development Order, and state law defines a rezoning as a <br />Development Order. He further explained that from the staff <br />level, you just have to know the capacity is there, but it <br />doesn't actually have to be reserved. When you get to site plan <br />approval, that is when concurrency dictates that capacity <br />actually be reserved and be available when a building permit can <br />be pulled. <br />Commissioner Scurlock stressed the importance of making sure <br />that we have our long range plans in order to make sure we are <br />capable of servicing these areas. He pointed out that we do not <br />know if we are going to build our own plant or acquire General <br />Development Utilities, and we only have a nebulous agreement with <br />the City for capacity at their plant. He further pointed out <br />that the Strazullas went ahead and paid for their reservation of <br />capacity for 650 ERUs, but it was noted that they already have <br />the zoning. <br />Commissioner Scurlock continued to emphasize that he just <br />wants to be sure we are careful so that someone who pays for <br />capacity all of a sudden can't get a permit when he is ready to <br />build because we haven't built our plant in the meantime. <br />Chairman Eggert felt what Commissioner Scurlock is <br />suggesting would amount to a moratorium, and Commissioner <br />Scurlock noted we could do as we did on Route 60 where the <br />45 <br />M M M <br />
