M M M <br />On August 13, 1990, the attorney representing the Thomas <br />Kennedy Estate, B.T. Cooksey, contacted staff with an offer <br />to sell the Kennedy parcel for the sum total of $165,000. <br />This total includes the following: <br />- 3.389 acres of right-of-way for Indian River <br />Boulevard <br />- 1.07 acre east uneconomic remainder, including all <br />severance damages <br />- all citrus trees within adjacent temporary <br />construction easements <br />- all severance damages to the west remaining property <br />- all incidentals as may apply except attorney's fees, <br />engineering fees, documentary stamps and title <br />insurance - <br />A condition of this sale is that it must be accomplished by <br />September 1, 1990. <br />The cost breakdown for the Kennedy parcel is as follows: <br />Sum total price $ 165,000 <br />Attorney Fee 9,900 <br />Recording Expenses 1,000 <br />Title Insurance 900 <br />Contingency 1,000 <br />Total $ 177,800 <br />A contingency has been included because closing documents <br />have not been finalized as of this date. Staff recommends <br />that the Board's authorization include this contingency to <br />cover any unforeseen costs to the county that may arise. <br />Carter Associates, Inc., have communicated with the county <br />on behalf of the property owners to insure that the road <br />design will not adversely impact the remaining land. The <br />property owners request that we pay engineering fees in the <br />amount of $1,194 to Carter Associates. <br />RECOMMENDATIONS AND FUNDING <br />Staff recommends that the Chairman be authorized to execute <br />the Contract to purchase right-of-way parcels from the <br />estate of Thomas Kennedy. <br />Staff also requests that the Board authorize payment of <br />engineering fees from Carter Associates. <br />Funding to be from account #309-214-541-066.12 Indian River <br />Boulevard North Right -of -Way. <br />Public Works Director Jim Davis advised that there has been <br />a change in the counteroffer made by the Kennedy family.
