Stormwater Management: The Stormwater Management Plan has <br />been approved by the Public Works Department, and a Type "A" <br />stormwater permit has been issued. <br />10. Landscape Plan: The landscape plan is in conformance with <br />Ordinance #84-47. <br />11. Environmental Concerns: This project is required to comply <br />with Comprehensive Plan Conservation Element Policy 6.12, <br />native upland vegetation preservation. The applicant will <br />comply with this requirement; however, the County cannot grant <br />an easement to itself. Therefore, the County must designate <br />and label on the site plan the area which will serve as the <br />preservation area in order to meet this requirement. The area <br />__designated to serve as the preservation area is the area at <br />the southeast of the site. Some limited, passive recreation <br />facilities such as a jogging trail will be located in the <br />general vicinity of the conservation area but will not be <br />included in the area calculation. The conservation area will <br />remain natural and will also include, over and above the <br />uplands area requirement, an existing pond and wetland area. <br />The preservation area will exceed the County requirements for <br />native upland vegetation preservation and will also preserve <br />(leave natural) an existing pond and wetland area. Prior to <br />release of any approved site plan, the plan must be revised to <br />depict and label the preservation area. <br />12. Utilities: The park will utilize county water and an --on-site <br />septic system. The connection to public water. service has <br />been approved by the Utilities Department. The final design <br />of the on-site septic facilities has not yet been approved by <br />the Environmental Health Department. The applicant is <br />coordinating with the Environmental Health Department to <br />determine the appropriate design for the septic facilities. <br />Revised site plans depicting the final approved design must be <br />submitted to the planning division prior to any approved site <br />plan release. <br />13. Dedications and Improvements: <br />a. The subject site has frontage on Oslo Road which is <br />classified as a principal urban arterial which requires <br />130 feet of road right-of-way. Presently there is a 50' <br />of right-of-way existing for Oslo Road. While the County <br />cannot dedicate right-of-way to itself, the design of the <br />park does not utilize the south 80' of the property. <br />This will be set aside to be utilized as future road <br />right-of-way for Oslo Road. <br />Additional right-of-way is not required for 20th Avenue <br />since it is designated as a collector roadway requiring <br />an 80' right-of-way and has 112' of existing right-of- <br />way. <br />b. In accordance with the adopted' Indian River County <br />Bikeway and Sidewalk Plan, a 5' wide sidewalk is required <br />along the project's Oslo Road frontage and an 8' wide <br />bike path is required along the project's 20th Avenue <br />frontage. The County is committed to install these <br />improvements with the final phase of the development. <br />14. Specific Land Use Criteria - Special Exception Use: Parks and <br />playgrounds open to..the public. [25.1(0)(4)] <br />1. No off-street parking or loading areas or buildings and <br />structures shall be located closer than twenty (20) feet <br />to any property line abutting a residential district. <br />2. Any recreational use equipped with lighting to allow the <br />use of the facility after sunset or any facility such as <br />3 <br />16 <br />
