ON MOTION by Commissioner Wheeler, SECONDED by <br />Commissioner Scurlock, the Board unanimously approved <br />purchase of the requested items from the designated <br />sole sources per Staff recommendation as set out in the <br />preceding memo dated 1-8-91. <br />DECLARING LOTS 6 AND 7. BLOCK 80, TOWN OF FELLSMERE SURPLUS <br />The Board reviewed the following memo from Assistant to County <br />Administrator, Randy Dowling: <br />TO: Board of County Commissioners DATE: January 7, 1991w v <br />FILE: <br />THRU: James E. Chandler <br />County Administrator <br />SUBJECT: Declaring Lots 6 8 7, <br />Block 80, Town of Fellsmere <br />Surplus <br />FROM: Randy Dowling REFERENCES: <br />Ass t. to County Administrator' ' <br />BACKGROUND <br />The County Administrator's Office received a letter from Ms. Jennifer Godfrey <br />on January 2, 1991 inquiring about, purchasing two vacant county -owned lots <br />that are adjacent to her own lots within the Town of Fellsmere. The County <br />acquired these two lots in 1972 by tax deed. This property has been <br />reviewed by all necessary county departments and those departments have no <br />current or future interest in the property. <br />CURRENT <br />These two lots combined are -estimated to be valued less than $5,000, <br />therefore, F.S. 125.3512) states the procedure the county may follow when <br />disposing of such real property. The Statute states, "'When the board of <br />county commissioners finds that -the value of a parcel 'of real property is <br />$5,000 or less, as determined by a fee appraiser designated by the board or <br />as determined by the county property appraiser, and when, due to thesize, <br />shape, location, and value of the parcel, it . is determined by the board that <br />the parcel is of use only to one or more adjacent property owners, the board <br />may effect a private sale of the parcel. The board may, after sending notice <br />of its intended action to owners of adjacent property by certified mail, effect <br />a sale and conveyance of the parcel at private sale- without receiving bids or <br />publishing notice; however, if, within 10 working days after receiving such <br />mailed notice, two or more owners of adjacent property notify the board of <br />their desire to purchase the parcel, the board shall accept sealed bids for the <br />parcel from such property owners and may convey such parcel to the highest <br />bidder or may reject all offers." <br />RECOMMENDATION <br />Staff recommends that the Board declare Lots 6 8 7, Block 80, Town of <br />Fellsmere surplus; authorize staff to proceed with the sale under the <br />guidelines of-F.S. 125.35(2), and authorize the Board.: Chairman to execute all <br />necessary. sales documents.
