FEB 12 1�.1191 <br />An interlocal agreement has now been drafted, revised and reviewed <br />by Indian River County andSt. Lucie County staff. St. Lucie <br />County staff is presenting the proposed interlocal agreement to the <br />St. Lucie County Board of County Commissioners for its approval and <br />execution of the agreement. Indian River County staff is hereby <br />requesting that the Indian River County Board of County <br />Commissioners approve and execute the proposed interlocal <br />agreement. <br />ANALYSIS: <br />The proposed agreement addresses the issues normally associated <br />with development application review and approval; it assigns <br />construction permitting and inspection authority and responsibility <br />to Indian River County. Also, the agreement provides for approval <br />by the constitutional officers and school boards and -any of their <br />comments. All applicable comprehensive plan and land development <br />regulations of both counties will need to be satisfied by any <br />proposed development on the subject property. Traffic impact fees <br />will be split 60/40; with 60% going to Indian River County, 40% <br />going to St. Lucie County. Concurrency approval will be reviewed <br />and determined under Indian River County's concurrency management <br />system. Indian River County staff have no objections to the <br />proposed agreement. The St. Lucie County Attorney's office <br />indicates that St. Lucie County staff have no objections to the <br />agreement. Approval of the agreement will allow permitting to <br />proceed and the residence to be constructed. <br />RECOMMENDATION: <br />Staff recommends that the Indian River County Board of County <br />Commissioners approve the attached interlocal agreement with St. <br />Lucie County and authorize the chairman to execute the agreement. <br />Said agreement shall become effective upon proper execution by both <br />counties. <br />Chairman Bird believed Clerk Barton had some concerns about <br />this matter and Commissioner Scurlock believed that he has the same <br />concerns as the Clerk, that while what is proposed may resolve a <br />temporary situation, this can have continuing problems regarding in <br />which county to file certain papers, etc. Although he would <br />support Staff's recommendation to approve the interlocal agreement <br />he would ask that we also authorize Staff to contact our <br />Legislative Delegation and that of St. Lucie County in regard to <br />recommending a Special Act that would place this property entirely <br />in one county or the other, as he does not want to approve this <br />without at least an attempt being made to clarify it for the <br />future. <br />Staff agreed they can pursue that. <br />Clerk Barton felt that the action suggested by Commissioner <br />Scurlock basically will handle the long term problems that could <br />arise from having to track records in two counties and he agreed <br />that something needs to be done to clear this problem now rather <br />than waiting for problems to arise in the future. <br />16 <br />- M M <br />
