APR 21991 <br />AGREL•:HCUT <br />moF 83 F"U'E 2 <br />Indian River <br />County Commissioners <br />This agreement is made by and 'between Y_ —F <br />a political subdivision of the State of Florida (the County), and <br />the FLORIDA HIGHWAY PATROL, a division of the Florida Department <br />of Highway Safety and Motor Vehicles (FHP), pursuant to Section <br />163.01, Florida Statutes, authorizing interlocal agreements. <br />In consideration of mutual promises contained in this inter- <br />local agreement, the County and FHP accept the following terms <br />and conditions: <br />1. Radar <br />For the purpose of this agreement, radar shall mean law <br />enforcement speed radar, any microwave -based speed -measurement <br />unit that meets the minimum design criteria established by the <br />Department of -Highway Safety and Motor Vehicles (HSMV) and is <br />employed for use in the State of Florida by a law enforcement <br />agency to detect the speed of motorists. As contemplated by this <br />agreement, radar units shall include any hardware necessary for <br />the operation and maintenance of such equipment, including tuning <br />forks. The radar equipment governed by this agreement was <br />purchased by the County for operation by the FHP within <br />Indian River County <br />2. Maintenance of Radar Equipment <br />Indian River County _ shall be the <br />lawful owner of the radar. Florida Highway Patrol <br />shall be the custodian and shall be responsible for the mainten- <br />ance and repair of such radar equipment. FHP shall be responsi- <br />ble for the installation and operation of such equipment as <br />required by Ehe laws of Florida and the rules, policies, and <br />procedures of HSMV. <br />20 <br />
