F, <br />APR <br />BOOK 8 <br />��a <br />rrr !r <br />Discussion followed regarding the actual property leased and <br />the amount to be paid yearly for its use. <br />Alan Gabriel, BellSouth Mobility, Inc., came before the Board <br />and advised that they have a lease with the County that does <br />provide for the fall radius as an easement. He demonstrated on the <br />drawing the yellow leased area (marked with diagonal lines) plus <br />the pink easement area (marked with vertical lines). He stressed <br />the easement area is just for fall purposes and it is addressed in <br />the lease. <br />Commissioner Scurlock asked if this easement precludes the <br />County from utilizing that area. <br />Mr. Gabriel answered no, the County can put anything there it <br />wants to; it's just an area that is set aside for fall purposes. <br />He further explained that the tower is designed to fall down upon <br />itself; it does not fall out and away. <br />County Attorney Vitunac explained the Utility Department did <br />not want to lease the whole pink area because they want to use that <br />for our purposes. <br />Mr. Gabriel demonstrated on the drawing the extent of the area <br />they will use and indicated where the monuments for the guy wires <br />were installed, which is the reason for the easement. <br />Discussion continued regarding the uses the County might have <br />for the easement area, the screening requirements, and what exactly <br />BellSouth would do with the indicated area, and the fact that the <br />vegetation requirements are part of the Land Development <br />Regulations. <br />Assistant Attorney Collins clarified that only part of the <br />pink area is to be used for the native vegetation preservation area <br />and since the tower is not designed to fall on the north side of <br />the property, the intent is to use the area south of the tower for <br />the 0.29 acre set-aside. Everything except that set-aside area and <br />where the guy wires are anchored would be available for County use. <br />Commissioner Eggert suggested clarifying those points in the <br />lease agreement rather than make it look like the whole thing has <br />to be kept in native vegetation. <br />Commissioner Bowman thought that inasmuch as this is a special <br />exception and this is a very special endangered sensitive area, we <br />should leave it alone. She added that saving less than three acres <br />out of almost twenty acres is not her idea of conservation. <br />Community Development Director Keating commented that Mr. <br />Collins was referring to the native vegetation set-aside, which is <br />0.29 acre. There is also another requirement to provide screening <br />in the lower part of the tower and that can be in the same acres. <br />Commissioner Eggert quoted "screening and landscaping must be <br />34 <br />
