I <br />APR 2 3 1991 MOI< 83 F,AEEj50, <br />•3. a Warranty/Maintenance Agreement and Bill of Sale for the <br />performance of the completed, publicly dedicated improvements; <br />4. an Engineer's Certified Cost Estimate for the constructed <br />required improvements (basis for figuring the security amount <br />for warranty/maintenance agreement); <br />5. a Contract for Construction for Remaining Required <br />Improvements - Sidewalks, to guarantee the subdivision <br />sidewalks will be completed; and <br />6. a Certified Engineers Cost Estimate for the remaining required <br />sidewalk improvements (basis for figuring the security amount <br />for the Contract for Construction). <br />The applicant has obtained document information from the County <br />Attorney's Office to be used in the security arrangements required <br />to guarantee the Warranty/Maintenance Agreement and Contract for <br />Construction for Required Improvements - Sidewalks. The final <br />security arrangement documentation must be submitted to the County <br />Attorney' s Of f ice for review and approval prior to recording of the <br />plat in the Public Record. <br />ANALYSIS: <br />The required improvements, except for sidewalks, have been <br />;constructed by the developer. The developer has submitted a <br />Warranty/Maintenance Agreement and a Contract for Construction for <br />the Required Sidewalks and has obtained the document forms required <br />for security arrangements to support the Warranty/Maintenance <br />Agreement and Contract for Construction. The final security <br />arrangements must be submitted to the County Attorney's Office for <br />review and approval before the plat may be recorded. With <br />submission of the approved final security arrangements, the <br />developer has effectively satisfied the requirements for final plat <br />approval for Phase 1. <br />RECOMMENDATION: <br />Staff recommends that'the Board of County Commissioners: <br />1. grant final plat approval for the Colonial Gardens, Phase 1, <br />Subdivision; <br />2. authorize the Chairman to execute the submitted Contract for <br />Construction; <br />3. accept the submitted Warranty/Maintenance Agreement; and <br />4. Authorize the County Attorney's Office to approve and accept <br />the security instruments submitted to secure the Contract for <br />Construction and Warranty/Maintenance Agreement prior to <br />recording the plat. <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Scurlock, the Board unanimously granted <br />final plat approval for Colonial Gardens Subdivision, <br />Phase I, as set out in the above staff recommendation. <br />CONTRACT FOR CONSTRUCTION AND WARRANTY MAINTENANCE AGREEMENT WILL <br />BE PLACED ON FILE IN THE OFFICE OF THE CLERK TO THE BOARD WHEN <br />FULLY EXECUTED AND RECEIVED <br />4 <br />
