Van Fleet Water Production Facility Improvements BVP 13-196 <br /> 7.13.1.2 If the Professional determines that a change in the Contract Documents is required <br /> because of the action taken by the Contractor in response to such an emergency, a Change Order will be <br /> issued to document the consequences of such action. <br /> 7.14 Submittals and Samples <br /> 7.14.1 After checking and verifying all field measurements, the Contractor shall promptly submit to the <br /> Professional for approval, in accordance with the accepted schedule of submittals, all submittals and <br /> samples required by the Contract Documents. All submittals and samples shall have been checked by and <br /> stamped with the approval of the Contractor and identified as the Professional may require. The data <br /> shown on or with the submittals will be complete with respect to dimensions, design criteria, materials <br /> and any other information necessary to enable the Professional to review the submittal as required.At the <br /> time of each submission, the Contractor shall give notice to the Professional of all deviations that the <br /> submittal or sample may have from the requirements of the Contract Documents. <br /> 7.14.1.1 The Professional shall review and approve submittals and samples. The Professional's <br /> review and approval shall be only for conformance with the design concept of the Project and compliance <br /> with the information given in the Contract Documents. The approval of a separate item as such will not <br /> indicate approval of the assembly in which the item functions. The Contractor will make any corrections <br /> required by the Professional and resubmit the required number of corrected copies until approved. The <br /> Contractor's stamp of approval on any submittal or sample shall constitute its representation to the <br /> Professional and the County that the Contractor has determined and verified all quantities, dimensions, <br /> field construction criteria, materials, catalog numbers and similar data; and that each submittal or sample <br /> has been reviewed or coordinated with the requirements of the Work and the Contract Documents. <br /> 7.14.1.2 No Work requiring a submittal or sample submission shall commence until the <br /> submission has been approved by the Professional. A copy of each approved submittal and each <br /> approved sample shall be kept in good order by the Contractor at the site and shall be available to the <br /> Professional and the County staff. Any delays associated with the submittal process will be considered <br /> for time extensions only, and no damages or additional compensation for delay will be allowed. <br /> 7.14.1.3 The Professional's approval of submittals or samples shall not relieve the Contractor <br /> from responsibility for any variation from the requirements of the Contract Documents unless the <br /> Contractor has in writing called the Professional's attention to each such variation at the time of <br /> submission and the Project Manager has given written approval to the specific deviation; any such <br /> approval by the Professional shall not relieve the Contractor from responsibility for errors or omissions <br /> in the submittal. <br /> 7.14.1.4 Where a shop drawing or sample is required by the Contract Documents or the <br /> schedule of shop drawings and sample submissions accepted by the Professional as required, any related <br /> work performed prior to the Professional's review and approval of the pertinent submittal will be at the <br /> sole expense and responsibility of the Contractor. <br /> 7.15 Cleaning Up <br /> 7.15.1 The Contractor shall maintain the site free from accumulations of waste material, rubbish and <br /> other debris or contaminates resulting from the work, at a minimum, on a daily basis or as otherwise <br /> required. At the completion of the work, the Contractor shall remove all waste material, rubbish and <br /> debris from the site as well as all tools, construction equipment, machinery and surplus material; and will <br /> leave the site clean and ready for occupancy by the County. All disposals shall be in accordance with <br /> applicable laws and regulations. In addition to any other rights available to the County under the Contract <br /> Documents, the Contractor's failure to maintain the site may result in withholding of any amounts due <br /> 74 <br />
