Van Fleet Water Production Facility Improvements BVP 13-196 <br /> 22.1.2 Allowance Work, in the amount of five percent (5%) of the engineer's/architects' estimate may <br /> be included in the Contract Price. No individual allowance request shall be greater than $40,000 without <br /> approval of the Board of County Commissioners. The Contract Work and all Allowance Work shall be <br /> performed in full compliance with all requirements of the Contract Documents. The sum of all approved <br /> Allowance Work performed pursuant hereto shall not exceed the amount of the Allowance. When all <br /> Work has been completed under this contract any balance of the original Allowance remaining at the <br /> completion of all Work shall be deducted from the Contract Price. <br /> 22.1.3 The number of calendar days specified in the Contract for performance of the Work may, at the <br /> County's sole discretion, include a total time allowance of no more than 30 days or ten percent(10%) of <br /> the time specified at the time contract award for final completion of the Project, whichever is less, for <br /> performance of Allowance Work. When all Work has been completed under this contract any time set <br /> aside for Allowance Work remaining at the completion of all Work shall be deducted from the Contract <br /> Time. <br /> 22.1.4 Upon a determination by the County Manager or his designee that certain construction work for <br /> which detailed specifications were not prepared or the scope of such work was not fully established at the <br /> time the County entered into a contract and upon determining that, for the purposes of expediency and <br /> efficiency, it would be in the County's best interest to have said work completed by the Project's <br /> Contractor,the County Manager or his designee will take appropriate action pursuant to the"Allowance" <br /> provision established under the Contract for the Project. <br /> 22.1.5 All charges and time for Allowance Work must be pre-approved in writing by the County <br /> Manager or his designee. Said written pre-approval shall be in the form of an Allowance Authorization <br /> Release (AAR), which shall describe in detail the Allowance Work to be performed, the price for the <br /> Allowance Work and the time, if any, allocated for performance of the Allowance Work, as well as <br /> containing the authorizing signature of the County Manager or his designee. The Contractor shall not be <br /> authorized to perform any Allowance Work without the required AAR. <br /> ARTICLE 23—ANNUAL APPROPRIATIONS <br /> 23.1 Appropriations <br /> 23.1.1 Contractor acknowledges that the County, during any fiscal year, shall not expend money, incur <br /> any liability, or enter into any agreement which, by its terms, involves the expenditure of money in <br /> excess of the amounts budgeted or the reduction of revenues for those budgeted agreements that may be <br /> available for expenditure during such fiscal year. Any agreement, verbal or written, made in violation of <br /> this subsection is null and void, and no money may be paid on such agreement. Nothing herein contained <br /> shall prevent the making of agreements for a period exceeding one year, but any agreement so made shall <br /> be executory only for the value of the services to be rendered or agreed to be paid for in succeeding fiscal <br /> years. Accordingly, the County's performance and obligation to pay under this agreement is contingent <br /> upon annual appropriation. <br /> 92 <br />
