East of the subject site,across 58th Avenue,is the Waterway Village development which has an L-2(up <br /> (moo, to 6 units per acre)land use designation and is zoned PD(Planned Development). The western portion <br /> of the Waterway Village development adjacent to the subject site has been substantially developed with <br /> single-family lots ranging from 35' wide to 70' wide. <br /> West of the south half of the subject site,all of the property lies outside the Urban Service Area,has an <br /> AG-1 (Agricultural up to 1 unit per 5 acres) land use designation, and is zoned A-1 (Agricultural 1 up <br /> to 1 unit per 5 acres). Those A-1 zoned properties consist of large lot residential uses and a horse <br /> farm/training facility. <br /> Consistency with the Comprehensive Plan <br /> Rezoning requests are reviewed for consistency with the policies of the comprehensive plan and must <br /> also be consistent with the overall designation of land uses as depicted on the Future Land Use Map. <br /> Those include agricultural,residential,recreational,conservation,and commercial and industrial land <br /> uses. Commercial and industrial land uses are located in nodes throughout the unincorporated areas of <br /> Indian River County. <br /> In this case, the underlying land use designation of the subject property is L-2, Low Density <br /> Residential-2. Since PDTND zoning is allowed in the L-2 land use designation category,the proposed <br /> rezoning is consistent with the Future Land Use Map. <br /> Other than the Future Land Use Map,the goals,objectives and policies are the most important parts of <br /> (W the comprehensive plan. Policies are statements in the plan that identify the actions that the county will <br /> take in order to direct the community's development. As courses of action committed to by the county, <br /> policies provide the basis for all county land development related decisions. While all comprehensive <br /> plan policies are important, some have more applicability than others in reviewing rezoning requests. <br /> Of particular applicability for this request are the following policies and objectives. <br /> Land Use Polio:Indian River County's land development regulations shall,through various means, <br /> ensure that adjacent land uses are compatible. Those means shall include,but not be limited to,use of <br /> the following: <br /> • vegetative buffers; <br /> • setbacks; <br /> • open space; <br /> • physical separation; <br /> • regulation of lighting; <br /> • regulation of hours of operation; and <br /> • regulation of access. <br /> Note: The proposed rezoning/conceptual PD plan meets or exceeds applicable land <br /> development regulations and provides special setbacks, buffers, parks, open spaces; <br /> conservation areas, and aesthetic improvements to ensure compatibility internally and <br /> externally.
