O'Brien - Assistant County Attorneyo <br />DATE:- July 30, 1991 <br />RE: REQUEST FOR DATE OF PUBLIC HEARING <br />The Sheriff has requested that this office prepare the attached <br />ordinance which should assist the Sheriff in the war on drugs. A <br />similar ordinance was upheld in the Second Circuit (see attached news- <br />paper article) . <br />The County looked at a different approach to the problem in 1989 when <br />it considered and rejected the establishment of a "Drug Nuisance Abate- <br />ment Board". It was apparently felt that the primary impact of "Board" <br />action would be against the innocent property owner rather than the <br />seller. A copy of the County's letter to the Sheriff is attached for <br />ease of reference. <br />The thrust of the "loitering in drug area" ordinance would be directed <br />to the illegal seller and buyer -of the controlled substances. <br />A date of August 27, 1991 is suggested for a public hearing. <br />ON MOTION by Commissioner Eggert, SECONDED by Com- <br />missioner Wheeler, the Board unanimously authorized <br />staff to advertise a public hearing to be held on <br />August 27, 1991 on the proposed "loitering in drug <br />area" ordinance. <br />DISCUSSION OF REMOVAL OF BARRIER IN COUNTY R/W (MADELINE KAYE) <br />The Board reviewed memos from Attorney O'Brien as well as <br />memo from Public Works: <br />TO: James E.
