AU 6 6 Wl' <br />BOOK 83 F, -L a 0 - <br />Madeline Kaye, 7840 128th Court, Roseland, came before the <br />Board and noted that she had a copy of her deed with her and also <br />has her survey, which she submitted for the Board to review. Ms. <br />Kaye advised that the reason she blocked off the road was because <br />for 4 months she and the lady who lives with her were harrassed <br />and verbally abused by the people who rented across from them and <br />who were drag racing and revving the motor of their pickup truck, <br />and making rude gestures, using profanity, etc. Their 4 -wheeler <br />actually jumped the barricade. Ms. Kaye advised that since the <br />woman who lives with her has angina and cannot tolerate this kind <br />of upset, she talked to Public Works Director Jim Davis, who <br />verbally gave her permission to close the road. She told him <br />that she would open it after all this was over with. <br />Ms. Kaye further noted that whenever the County comes down <br />to clean the ditch behind her, they will not go on the other side <br />of what they say is a 35' easement to clean the culvert on that <br />side because they say it is her private property; so she wants to <br />know just whose property it is. None of this makes sense to her, <br />and no one is ever in the Code Enforcement Office to answer <br />anything. Ms. Kaye informed the Board that the barricade has <br />been taken away since she heard from Attorney O'Brien, and she <br />would like to have the road maintained. There is no barricade, <br />but she does have posters on her fence because she doesn't need <br />the drag racing. These posters just say "No Trespassing," and <br />these are on her fence, and it is her property. <br />Commissioner Scurlock believed that if the barricade is <br />down, then there is no action being requested of the Board as far <br />as fines, etc., but apparently Ms. Kaye is indicating that she <br />would like some action from the County in regard to maintaining <br />the ditch. <br />Ms. Kaye stated that the ditch alongside of there that they <br />call the right-of-way is only 2J' deep, and she gets flooded from <br />that because she has a pond behind her that is about 60' deep, <br />and she is clearing off the water from everyone's land and then <br />they dug a culvert to drain off from Powerline. <br />Commissioner Scurlock wished clarification. He believed Ms. <br />Kaye barricaded 78th Avenue, and along that road is a ditch; he <br />wished to know if that is the ditch she would like to have <br />cleaned. Ms. Kaye confirmed that it is. <br />Commissioner Bowman believed that ditch is part of the R/W, <br />and Administrator Chandler noted that he was not aware there was <br />a problem with the ditch and would like to take a look at it. <br />Ms. Kaye then referred to the "swale" between Powerline and <br />128th Court, which runs in the middle of the property line and <br />emphasized that it is not even maintained, and that so-called <br />22 <br />
