I <br />Commissioner Scurlock suggested if their desire is to use this <br />property as a retention area, if they would deed restrict the <br />property for public purposes and, in addition to that, provide <br />additional parking commensurate with working with their other <br />drainage problems, he would be in favor of selling the property <br />because without a restriction they have the ability to dispose of <br />the property for development. He felt a motion should include the <br />contingency of restricting the use of this property to public <br />purpose and/or public use, as well as the County having right of <br />first refusal if they are going to dispose of it. <br />Under discussion, County Attorney Vitunac suggested a followup <br />to Chairman Bird's suggestion that the boundary of the tracking <br />station, which is triangular, be extended parallel to the <br />coastline, making it rectangular. <br />Chairman Bird said another possibility is to create a new <br />property line and sell only the western -most portion of the <br />Tracking Station Park property equal in value to the Gifford Park <br />property and retain ownership of the eastern -most part for future <br />park expansion. <br />MOTION WAS MADE by Commissioner Scurlock, SECONDED <br />by Commissioner Eggert, to allow the Administrator <br />to conduct negotiations with the Town of Indian <br />River Shores on the sale/exchange of property to <br />include the contingency of restricting use of this <br />property for public purpose and/or public use and to <br />consider a new property line for the purpose of <br />creating acreage of equal value to the Gifford Park <br />property. <br />Chairman Bird asked if the Administrator understood the <br />flexibility. Administrator Chandler clarified his understanding is <br />to determine Tracking Station Park acreage equal in value to the <br />Gifford Park parcel and deduct it from the full parcel. <br />Chairman Bird added that we should determine that what we <br />retain is usable for access and possible expansion of our existing <br />park because if retaining more of the eastern -most portion of that <br />property would not benefit us, he would rather have the money. <br />Commissioner Eggert agreed. <br />Commissioner Wheeler asked if the subject property has any <br />deed restrictions at all with our title. <br />Administrator Chandler responded that staff checked that <br />aspect and there were no restrictions on it. <br />L_ <br />35 <br />a <br />BOOK.�A FH.UC WCL Js <br />
