The decision was made that if we grade it for four <br />years and do construction of the roadway, we can claim maintenance <br />map jurisdiction of it and not have to condemn property, so we <br />elected to go that route. <br />THE CHAIRMAN CALLED FOR THE QUESTION. <br />It was voted on and carried unanimously. <br />i <br />RESOLUTION NO. 91- 168 <br />A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS <br />OF INDIAN RIVER COUNTY, FLORIDA, PROVIDING FOR <br />CERTAIN PAVING AND DRAINAGE IMPROVEMENTS TO 10TH <br />COURT SW BETWEEN 11TH STREET SW AND 9TH STREET SW, <br />PROVIDING THE TOTAL ESTIMATED COST, METHOD OF <br />PAYMENT OF ASSESSMENTS,, NUMBER OF ANNUAL <br />INSTALLMENTS, AND LEGAL DESCRIPTION OF THE AREA <br />SPECIFICALLY BENEFITTED. <br />WHEREAS, the County Public Works Department has been <br />petitioned for Road Paving and Drainage Improvement for 10th Court <br />SW between 11th Street SW and 9th Street SW. <br />WHEREAS, the construction of paving and drainage <br />improvements by special assessment funding is authorized by Section <br />11-21, 11-22, and:11-41, Indian River County Code of Laws and <br />Ordinances; and cost estimates and preliminary assessment rolls <br />have been completed.by the Public Works Department; and the total <br />estimated cost of the proposed paving and drainage improvements is <br />FORTY THREE THOUSAND, FOUR HUNDRED EIGHTY SEVEN DOLLARS and EIGHTY <br />CENTS ($43,487.80)= and <br />WHEREAS, the special assessment provided hereunder shall, <br />for any given record owner of property within the area specially <br />benefited, be in. an amount equal to that proportion of twenty-five <br />percent (25%) of the total cost of the project ($10,871.95) which <br />the number of lineal feet of road frontage owned by the given owner <br />bears to the, total number of lineal feet of road frontage within <br />the areas specially benefited and seventy-five percent (75%) of the <br />total cost of the project ($32,615.85) will come from Petition <br />Paving Account; and <br />53 <br />NOV 0 5 IqW BOOK NE L <br />L_ <br />
