11AR 24,1992, <br />6. The Coalition has requested that the other tenants have an opportunity <br />to cure any default in payment of rent by the Coalition. This is <br />provided for in paragraphs 8c and 12 of the lease. <br />Should the Board decide to approve the lease in its present form, a <br />resolution as attached must be passed pursuant to Florida Statute 125.38. <br />Deputy County Attorney Will Collins further explained that the <br />Coalition for the Homeless of Indian River, County, Inc., would be <br />the Lessee and propose to have subtenants within the building, but <br />we would look directly to the Coalition for rental payments and <br />they would be responsible to collect from subtenants. <br />Chairman Eggert drew the Board's attention to Paragraph 13.d., <br />and suggested the last sentence should be changed to read, "The <br />premises shall not be utilized for purposes of showering, locker <br />facilities, meals or overnight stays by those people of Indian <br />River County who are the clientele of lessee or sublessees, with <br />the exception of coffee and doughnuts, when and if people visit the <br />offices to avail themselves of any services which are available on <br />premises.,, <br />Commissioner Bowman was concerned about the condition of the <br />roof and was not sure patching would do the job. <br />County Administrator Jim Chandler agreed the roof was a major <br />concern because a leaking roof could cause damage to the interior <br />of the building. He advised that the superintendent of Buildings <br />and Grounds inspected the roof and conferred with a representative <br />of Lucas Roofing, and they believe the roof can be repaired and <br />would last for the duration of the lease. <br />Commissioner Scurlock pointed out that at the end of this <br />lease the County may try to dispose of this asset and he would hate <br />to invest $18,000 in a new roof and then see someone buy the <br />property and demolish the building. He was in favor of delaying <br />replacement of the roof as long as we have assurances that the <br />repair will last for three years <br />Henry Muller, Director of the Coalition, confirmed that the <br />roof has one area that needs to be patched, and the roofer will <br />patch it and maintain it for the Coalition for three years without <br />charge. He assured the Board there will be no damage to the <br />building as a result of any leaks. <br />Commissioner Bird led discussion regarding responsibility for <br />maintenance and repairs, and Mr. Muller confirmed that excepting <br />major structural items, all normal repairs and maintenance will be <br />borne by the Coalition. <br />Attorney Collins further explained that in differentiating <br />between major and minor repairs, the distinction is that any items <br />that are necessary for the structural integrity of the building <br />would be the County's responsibility but any minor maintenance, <br />16 <br />
