CH2M Hill, Inc., Deerfield Beach, Florida, for the design, <br />permitting, b�ddinqq, and resident engineering inspection services <br />for a deep injection well at the proposed location on the County <br />landfill property (see attachment). <br />ANALYSIS <br />Pursuant to the requirements of Chapter 17-28.27(9) of the Florida <br />Administrative Code, the DER may order a well plugged if it is <br />determined that there is a threat to the waters of the State. The <br />permit shall require the permittee to maintain financial' <br />responsibility and resources, in the form of performance bonds or <br />another equivalent form of financial assurance approved by the <br />Department of Environmental Regulation to close; plug, and abandon <br />the underground injection operation in a manner prescribed by the <br />DER. The current plugging and abandonment cLost is estimated at <br />$291,050.00. This cost shall be reviewed on an annual basis, and <br />this obligation shall incorporate accumulated inflation costs. <br />RECOMiU MON <br />The Department of Utility Services recommends the acknowledgment and <br />approval of the Certification of Financial Responsibility as <br />attached, which must be submitted to the Department of Environmental <br />Regulation as a requirement to the issuance of the subject <br />construction and operation well permit. <br />Commissioner Bird asked if this money has to -be put up in the <br />form of a bond or something, and Utilities Director Terry Pinto <br />advised that it does not. We just have to prove that;we have the <br />ability. <br />Commissioner Bird understood then that it is not a cash <br />requirement at this time and that money does not have to be <br />escrowed or anything else at this time. <br />Commissioner Scurlock explained that what we are doing here, <br />basically, is pledging the full resources of the county's taxpayers <br />if this ever has to undergo a major cleanup. We are guaranteeing <br />that we will tax the citizens of Indian River County to pay for it, <br />whatever the cost. <br />Commissioner Bowman pointed out that it would not be a <br />cleanup, it would be plugging it and saying goodbye to it forever. <br />Director Pinto pointed out that we do this very same thing <br />every time we build a wastewater treatment plant, landfill, etc. <br />ON MOTION by Commissioner Bird, SECONDED by <br />Commissioner Scurlock, the Board by a 3-1 vote <br />(Commissioner Bowman dissenting) acknowledged and <br />approved the Certification of Financial <br />Responsibility, as set out in the above staff <br />recommendation. <br />CERTIFICATION IS ON FILE IN THE OFFICE OF THE CLERK TO THE BOARD <br />32 <br />
