c. Should a Subcontractor cause damage to the Work or property of another Contractor or <br />subcontractor, he shall be directly responsible, and upon notice, shall promptly settle the <br />claim or otherwise resolve the dispute with the affected party. <br />ARTICLE 12 - SUBCONTRACTS AND SUBCONTRACTORS <br />a. Within fourteen (14) days after award of the Contract, the Contractor shall submit to the <br />Director a list giving the names and addresses of Subcontractors he proposes to use, <br />together with the scope of their respective parts of the Work. Should any Subcontractor <br />be disapproved by the Director, the Contractor shall submit a substitute for approval. The <br />Director shall act promptly in the approval of Subcontractors, and when approval of the <br />list is given, no changes of Subcontractor will be permitted except for cause or reason <br />considered justifiable by the Director. <br />b. The Director will, at his discretion, furnish to any Subcontractor, upon request, evidence <br />regarding amounts of money paid to the Contractor on account of the Subcontractor's <br />work. <br />c. The Contractor is and remains fully responsible for his own acts or omissions as well as <br />those of any Subcontractor or of any employee of either. The Contractor agrees that no <br />contractual relationship exists between the Subcontractor and the County in regard to the <br />Agreement, and that the Subcontractor acts on this work as an agent or employee of the <br />Contractor. <br />d. The County reserves the right to limit the amount of portions of work to be subcontracted <br />as hereinafter specified. <br />ARTICLE 13 - CONTRACTOR AND SUBCONTRACTOR RELATIONSHIPS (Not Used) <br />ARTICLE 14 - DIRECTOR'S STATUS <br />a. The Director shall provide general administration of the performance of construction <br />contracts. He is the agent of the County only for the purpose of implementing the <br />operations contract and constructing this work to the extent stipulated in the Agreement <br />Documents. He has authority to stop work or to order work removed, or to order <br />corrections of faulty work where such action may be necessary to assure successful <br />completion of the Work and total project. <br />b. Should the Director cease to be employed on the Work for any reason whatsoever. then <br />the County shall employ a competent replacement who shall assume the status of the <br />former Director. <br />c. The Director or Engineer will make visits to the site at intervals appropriate to the various <br />stages of Work to observe the progress and quality of the executed work and to <br />GC -8 <br />pp9856109-30.97 <br />• <br />,:1 <br />
