PINTO <br />DIRECTOR OF UTIL T <br />WILLcCAI <br />CES <br />AL CTS ENGINEER <br />OF UT-;LITY SERVICES <br />DEVELOPER'S AGREEMENT WITH INDIAN BEACH ASSOCIATES <br />FOR THE OLDE OAK PARK SUBDIVISION <br />The Indian Beach Associates are developing a 114 -unit subdivision, <br />depicted as Olde Oak Park on Exhibit A of the attached Developer's <br />Agreement. The developer is proposing to construct a regional lift <br />station (as identified in the Indian River County Wastewater Master <br />Plan dated February 1988) in conjunction with this project, and also <br />that the cost of this construction will be shared with the County <br />Utilities Department as outlined in County Ordinance No. 91-9, <br />Section 201.11. The total construction cost is estimated at <br />$75,074.00. Indian River County's portion of this cost would be <br />$58,632.79. <br />ANALYSIS <br />The construction of this lift station was first planned for in the <br />construction of the second phase of Tamara Gardens in 1988. Before <br />the completion of the Tamara Gardens Project, construction was <br />halted by the developer, and the agreement between the County and <br />developer was voided. Also, at this same time, Cambridge Park (see <br />Exhibit A for location) designed and constructed its wastewater <br />system to convey its sewage to this regional lift station, along <br />with the other surrounding areas. Due to the existing development <br />and wastewater system designs in the surrounding areas, the ongoing <br />update of the Wastewater Master Plan will not eliminate the <br />necessity of this lift station. <br />The total design flow of the lift station is 156,500 GPD, of that <br />flow 34,200 GPD will be generated by Olde Oak Park, or 21.9% of the <br />total flow. The County's (or surrounding area flow) is 122,300 GPD, <br />or 78.1% (see Exhibit A of the attached agreement). For additional <br />details, please see the attached agreement. The funding for this <br />project will be from the Indian River County Utilities Department <br />impact fee fund. <br />RECOMMENDATION <br />The staff of the Department of Utility Services recommends that the <br />Board of County Commissioners approve the attached Developer's <br />Agreement with Indian Beach Associates, as attached. <br />56 <br />
