Davis, P.E., <br />Public Works Director Oe <br />SUBJECT: Donation of Right -of -Way Agreement Addendum <br />Indian River Boulevard Phase IV <br />DATE: September 8, 1992 FILE: irbrwext.agn <br />DESCRIPTION AND CONDITIONS <br />On November 1, 1988, the County entered into an Agreement with <br />Equal Split, Inc. donating to the County right-of-way for the <br />extension of Indian River Boulevard provided the County would <br />make certain access improvements and complete the Boulevard by a <br />certain time period. <br />The attached agreement addendum is to extend the original Nov. 1, <br />1988 agreement by two years so that Indian River Boulevard Phase <br />IV can proceed. <br />ALTERNATIVES AND ANALYSIS <br />The following alternatives are presented. <br />Alternative No. 1 <br />Authorize the Chairman to execute Addendum No. 1 to the <br />Agreement. <br />Alternative No. 2 <br />Deny the Authorization thereby forfeiting the extension of <br />time. <br />RECOMMENDATIONS AND FUNDING <br />Staff recommends Alternative No. 1. No funding to be expended. <br />Public Works Director Jim Davis advised that staff has <br />contacted the Lawton family who also are -donating right-of-way and <br />they would like to see some language in Item 6 of Addendum No. 1-A <br />regarding the County's obligation if Phase IV of the Boulevard is <br />not completed by 1994. Director Davis didn't see a problem in <br />completing Phase IV by November 24, 1994 and suggested that the <br />same language be inserted in Item #6 in the Agreement with Equal <br />Split, Inc.
