Board of County Commissioners Meeting Minutes - Final January 9, 2018 <br />14.E.1. 18-1356 Millstone Landing Planned Development Developer's Agreement <br />Recommended Action: Discussion <br />Attachments: Commissioner's Memorandum <br />Millstone Landing Developers Agreement - 1 st Amendment <br />Commissioner Zorc provided a timeline of events for the Millstone Landing <br />project and the 17th Street SW intersection improvements, and discussed the <br />Developer's (SLV Millstone, LLC) inability to meet the deadlines that were <br />outlined in the Developer's Agreement. He asked for a waiver of a portion of <br />the Developer's Agreement allowing Certificates of Occupancy to be issued on <br />the homes that were now completed in order to provide relief for those home <br />owners. <br />Steve Moler, Professional Engineer from Masteller and Moler, Inc., present <br />with Attorney Bruce Barkett from Collins Brown Barkett Garavaglia & Lawn, <br />Chartered, provided details on the delays involved with the construction of the <br />Millstone Landing Development and the I7th Street SW intersection <br />improvements project. <br />Public Works Director Richard Szpyrka agreed that there were problems <br />involved with the project; however, it was his opinion that the Developer had <br />not made a good faith effort in the construction of the project. He provided <br />details on the specific improvements that would need to be completed before <br />moving forward. <br />Chairman O'Bryan expressed his disappointment in the delays involved with <br />the project, and was not in favor of waiving any of the requirements in the <br />Developer's Agreement. He suggested a Special Call Meeting on January 30th, <br />2018, dependent on a site inspection from the Public Works Director to <br />determine if the Developer had made enough significant progress to allow for <br />the consideration of an extension to the Agreement. Upon completion of the <br />inspection, if the Public Works Director was not satisfied that sufficient <br />progress had been made; there would be no Special Call Meeting. <br />Bill Kouwenhoven, 6310 Capital Drive, HOA Director for Starwood Land <br />Ventures, LLC explained that the delays were caused by events beyond their <br />control, and that there had been a good faith effort made with regard to the <br />project. <br />Indian River County Florida Page 13 <br />
