JAMES H. NOBIL) <br />'BACKGROUND: <br />The proposed water tower for the North County water system is <br />abutting to the developer's Riverwalk Shopping Center, Phase II <br />project (see attached drawing). Originally, the developer came to <br />the County with a plan to construct a water distribution system for <br />the shopping center. The County is aware of the need to upsize the <br />proposed water main to master plan size to serve the new water <br />tower. Based on the location of the tower and this need to upsize, <br />the County has negotiated the construction of the master planned <br />water main with the developer at the time of their development. <br />This will alleviate the need for the County to install a master plan <br />size line to the new water tower in the immediate future. <br />The Department of Utility Services would like to enter into a <br />developer,'s agreement with Sebastian Associates, Ltd., for the <br />construction of this line. <br />ANALYSIS: <br />The County has completed the negotiations with the developer and has <br />come to an agreement. The County agrees to reimburse the developer <br />to a maximum amount of $92,214.32, in accordance with Indian River <br />County Ordinance No. 91-9 for the construction of approximately <br />2,195 lineal feet of 16" and 220 lineal feet of 12° water main as <br />outlined in Exhibit A (attached). <br />RECOMMENDATION: <br />The staff of the Department of Utility Services recommends that the <br />Board of County Commissioners approve, and the Chairman execute, the <br />attached developer's agreement with Mr. James H. Nobil for the <br />subject water main. <br />28 <br />
